Employment Tribunals Rules of Procedure 2013 – Rule 21[1]The claimant’s claim for notice pay holiday pay arrears of pay and other payments succeeds. The respondent will now pay the claimant the total amount of £1746.97. This is calculated as follows:a. In respect of the claim for an unlawful deduction of 20% from the claimant’s pay for the month of March 2020 the respondent will pay the claimant £191.08.b. In respect of the outstanding 47.7 hours of holiday accrued but unpaid on termination, paid at an hourly rate of £8.53 per hour the respondent will pay the claimant the sum of £406.88.c. In respect of an unlawful deduction from the claimant’s wages in respect of overtime paid at time and a half the respondent will pay the claimant the sum of £153.60.d. In respect of an unlawful deduction from the claimant’s wages in respect of bonus pay calculated a £40.00 per month the respondent will pay the claimant the sum of £40.00.e. In respect of notice pay the respondent will pay the claimant one month’s basic pay of £955.41.
