JUDGMENT

[1]The Judgment of the tribunal is that the claimant was unfairly dismissed for which the respondent shall pay to the claimant:a. Basic award: £2,352.00b. Compensatory award £3,942.40 (including 10% uplift for breach of the ACAS code of practice).[2]The claimant’s claim for wrongful dismissal (notice pay) succeeds. No separate award for wrongful dismissal is made given the compensatory award made for unfair dismissal.[3]Pursuant to s.38 Employment Rights Act 2002, the respondent is ordered to pay the claimant £448.00 (2 weeks’ pay) for a failure to provide particulars of employment as required by section 1 Employment Rights Act 1996.[4]The total sum payable by the respondent to the claimant in accordance with this Judgment is therefore £6,742.40.
