JUDGMENT

UPON the Claimant being successful in his claims under ss. 20, 15 Equality Act 2010 and s. 98 Employment Rights Act 1998 And UPON a remedy hearing being held AND UPON hearing counsel for the Claimant and counsel for the Respondent AND UPON the parties agreeing that the Injury to Feelings award will be taxable IT IS ORDERED THAT:[1]The Respondent shall, within 14 days of the Order being sent to the parties, pay the Claimant the amount of £74,460.77.[2]That amount is comprised of:a. Injury to feelings of £10,000;b. Basic award of £14,416; Case Number: 1404297/2021c. Loss of statutory rights of £500;d. Loss of earnings of £27,992.45;e. Interest of £5,766.54;f. An amount of £15,785.78 to account for grossing up insofar as the total amount at 2a – 2e exceeds the Claimant's tax-free allowance of £30,000.[3]The parties are directed to inform the Tribunal of the position in relation to their agreement or otherwise as to the amount to be paid in respect of the Claimant’s pension loss by 25 October 2024. Young South Western Ambulance Service NHS Trust Exeter On: 26 September 2025 Employment Judge Smail in Chambers CONSENT JUDGMENT UPON the Claimant being successful in his claims under ss. 20, 15 Equality Act 2010 and s. 98 Employment Rights Act 1998 And UPON a remedy hearing being held on 13 September 2024 AND UPON reading correspondence from the parties AND UPON the parties’ agreement that the Injury to Feelings award will be taxable AND UPON a remedy judgment having been issued on 18 October 2024 IT IS ORDERED THAT:[1]The Respondent shall, within 14 days of the Order being sent to the parties, pay the Claimant the amount of £17,143.59.[2]That amount is comprised of:a. Pension loss of £12,620.90; Case Number: 1404297/2021b. An amount of £4,522.69 to account for grossing up insofar as the total amount of the Claimant's tax-free allowance of £30,000 was used up by the awards made pursuant to the previous remedy judgment sent to the parties on 18 October 2024.
