JUDGMENT
[1]The claimant was disabled by reason of Carpel Tunnel Syndrome from 2008 and by reason of depression from 27 November 2018.[2]The claimant’s claim of unauthorised deductions from wages was presented “out of time”.[3]It was reasonably practicable for it to have been presented in time and accordingly it is dismissed.[4]The claimant’s second claim having been accepted by the Tribunal, her (duplicate) third claim (1401756/2020) is dismissed (and the second respondent is dismissed from proceedings).[5]The claimant is entitled to take forward a claim under Section 38 of the Employment Act 2002 (failure to provide a statement of employment particulars) without amendment to her claim.[6]The claimant’s claims of whistleblowing detriment in her second claim are dismissed on the ground that they are an abuse of process.[7]By consent, the claimant’s claims for a redundancy payment and holiday pay are dismissed.
