JUDGMENT

It is the decision of Employment Judge Belton that:[1]The Respondent has made an unlawful deduction from the Claimant’s wages for the period 16-19 August 2021 inclusive and is ordered to pay the Claimant the gross sum of £352.[2]The Respondent made an unauthorised deduction from wages by failing to pay the Claimant in lieu of three days’ accrued but untaken holiday and is ordered to pay to the Claimant the sum of £300, being the gross sum unlawfully deducted.[3]The Claimant is also awarded a sum of £1000 (2 weeks’ gross pay) pursuant to S.38 Employment Act 2002 because of the Respondent’s failure to provide the Claimant with a written statement of employment particulars.
