The complaint of unfair dismissal is struck out.REASONS
[1]At a Preliminary Hearing on 17 April 2020 the Tribunal gave the claimant’s representative an opportunity to make representations as to why the complaint of unfair dismissal should not be struck out because he had less than two years’ service at the time of dismissal and so it has no reasonable prospect of success.[2]The claimant has failed to make any sufficient representations as to why this should not be done. The complaint of unfair dismissal is therefore struck out.[3]The claimant’s remaining claims for disability discrimination remain listed for hearing on 8 to 11 February 2021.
