UPON the claimant’s employment continuing AND UPON Regulations 13(16)(c) and Regulation 17 and 18 of the Working Time Regulations 1998 applying to the claimant’s entitlement to annual leave under Regulation 13 of the Regulations for the leave years 2022, 2023 and 2024 AND UPON the parties agreeing to calculate the corrected balance of annual leave due to the claimant so that may exercise his right to annual leave AND FURTHER UPON the claimant accepting that the respondent was entitled to make deductions in respect of an overpayment to him on 15 January 2023 The Judgment of the Tribunal is that the claims of unauthorised deduction of wages and unpaid annual leave are not well founded and are dismissed.
