JUDGMENT

[1]The Respondent has made an unlawful deduction from the Claimant’s wages by failing to pay the Claimant any holiday pay in the period from 6 May 2022 until 31 December 2022.[2]Alternatively the respondent has failed to pay the Claimant holiday pay for the period of 6 May 2022 until 31 December 2022.[3]The Claimant is entitled to holiday pay of £1072.87 calculated as followsa. The claimant worked for 33 weeks and is entitled to 5.6 x 33/52 weeks paid holiday.b. The claimant worked a total of 996.25 hours in the period, according to her pay slips. She earned £10 an hour.c. The claimant therefore earned £9862.50 over 33 weeks. Her average weekly pay was therefore £301.89.d. Her holiday pay is therefore 5.6 x 33/52 x £301.89 = £1,072.87[4]The Respondent will now pay the claimant the sum of £1,072.87 in respect of unpaid holiday pay. Case Number: 1403455/2023
