JUDGMENT

The complaint of Unfair Dismissal is struck out.

REASONS

[1]By a letter dated 13th October 2022 the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the complaint of Unfair Dismissal should not be struck out because it has not been actively pursued.[2]The Claimant has failed to make representations in writing, or have failed to make any sufficient representations, why this should not be done or to request a hearing. The complaint of Unfair Dismissal is therefore struck out. The respondent has failed to present a valid response on time. The Employment Judge has decided that a determination can properly be made of the claim in accordance with rule 21 of the Rules of Procedure.[2]The respondent has made unauthorised deductions from the claimant’s wages and must pay the claimant £1030.40.[3]The claimant was dismissed in breach of contract in respect of notice and the respondent must pay damages to the claimant of £815.12.[4]The respondent has failed to pay the claimant’s holiday entitlement and must pay the claimant £166.25.[5]The respondent must pay the claimant £2011.77 in total.[6]As the Claimant did not have 2 years’ service, she may neither claim unfair dismissal nor a redundancy payment.
