JUDGMENT
[1]Each of the complaints of disability Discrimination set out in claim 1403124/2022 are struck out.[2]The Claimants claim numbered 1400774/2022, as amended will continue as listed.REASONS
[1]At a preliminary hearing in person on 14 April 2023 before Employment Judge Rayner, the claimant’s first claim was amended, and the parties agreed a list of issues which contained all the claims the claimant wishes to pursue.[2]At that hearing the claimant agreed that the second claim was a duplication of the application to amend. The claimant further that since the application to amend has now been determined with the resulting agreed list of issues, the second claim was superfluous and unnecessary.[3]The respondent applied for the second claim to be struck out as it is superfluous and unnecessary, and therefore unreasonable for the claimant to pursue. The Claimant did not object.[4]The claim number 1403124/2022 is therefore struck out.[5]The remaining claim number 1400774/2022 remains listed for a nine day hearing on 23 to 31 October and 1-2 November 2023 6.3 Strike Out Judgment – claim – part - rule 37 Case Number: 1403124/2022
