The claim is struck out.REASONS
[1]The claimant was ordered to pay a deposit of £200.00 following a preliminary hearing held on 29/09/2022. The Order was sent to the claimant on 31/10/2022..The claimant has failed to pay this deposit and has not applied for a reconsideration of the order. Although the claimant’s representative wrote on 9 December 2022 alleging that their communication of 13 November 2022 was their ‘response’ to the deposit order that communication did not contain an application for a reconsideration of the deposit order or for further time to pay.[2]Therefore, when the claimant failed to pay the deposit, Case No: 1403110/2020 was therefore struck out under rule 39(4) of the Employment Tribunals Rules of Procedure 2013.[3]The hearing fixed for 13 January 2023 will still take place. This judgment does not affect Case No: 3313873/2021.
