JUDGMENT

[1]The claim is dismissed.

REASONS

[1]The Claimant made an application for a postponement of the hearing via email to the Tribunal on 18th January 2023 on the grounds that she was working in Kent and would not be able to attend.[2]This application was considered by REJ Pirani and was refused on the basis that the Claim Form was received by the Employment Tribunal on 13th September 2022. A notice of hearing was sent to the parties on 1st November 2022. This provided the Claimant with sufficient time to make arrangements for her attendance. Moreover, her application was predicated on the basis that the Claimant could not attend because of her location. This case was listed for Video Hearing where location is not relevant.[3]This morning, the Claimant was contacted by Tribunal staff and she confirmed she would not be attending the hearing today.[4]The hearing commenced with the Respondent’s representative present, ready to proceed. Having considered the reasons for the Claimant’s non attendance, the overriding objective, including the 10.2 Judgment - rule 61 Case No: 1402969/2022 costs and inconvenience this non-attendance has caused to the Respondent, this claim has been dismissed under Rule 47 of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013.
