Mrs N Riley v Post and Provisions Ltd: 1402772/2021 and 1402775/2021
JUDGMENT
The Claim is struck out (dismissed) pursuant to Rule 37 (1) (d) of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013.REASONS
[1]By a letter dated 15 December 2022 the Tribunal gave the Claimant an opportunity to make representations or to request a hearing, as to why the claim should not be struck out because the Claim had not been actively pursued following the Claimant’s non-attendance at the previous hearing.[2]The claimant has failed to make representations in writing as required or requested a hearing to consider the issue and in te absence of any response from the Claimant the tribunal is satisfied that the Claim is not actively being pursued and the Claim is therefore struck out.
