The part of the response whereby the Respondent disputes that the Claimant was a disabled person at the material time is struck out.REASONS
[1]The respondent was ordered to pay a deposit of £500 following a preliminary hearing held on 13/11/2023. The order was sent to the respondent on 22/11/2023. The respondent has failed to pay this deposit. The part of the response in which the Respondent disputes that the Claimant was a disabled person at the material time is therefore struck out under rule 39(4) of the Employment Tribunals Rules of Procedure 2013.[2]The public Preliminary Hearing fixed for 03/04/2024 will not take place. The further Case Management Preliminary Hearing will take place at 2pm on 14 June 2024 and the final hearing remains listed on 8-12 July 2024.
