JUDGMENT
[1]The Respondent terminated the Claimant’s contract of employment without notice in breach of contract.[2]The Claimant is awarded and the Respondent is ordered to pay to the Claimant damages for breach of contract for one month’s notice in the net sum of £1,531.25 (£2,041.67 gross per month less 25% for statutory deductions) pursuant to Article 4 of the Employment Tribunals Extension of Jurisdiction (England and Wales) Order 1994.[3]The Claimant is also awarded and the Respondent is ordered to pay to the Claimant a further sum of £382.81 (25% of £1,531.25) pursuant to section 207A of the Trade Union & Labour Relations (Consolidation) Act 1992 in respect of the Respondent’s failure to deal with the Claimant’s grievance in accordance with the ACAS Code of Practice 1: Disciplinary and grievance procedures (2015). Case no 1402350/2018[4]The Claimant is therefore awarded and the Respondent is ordered to pay the Claimant a total sum of £1,914.06 (£1,531.25 +£382.81).
