The complaint of constructive unfair dismissal is struck out.REASONS
[1]By a letter dated 18 August 2022 the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the complaint of unfair constructive dismissal should not be struck out because the claimant did not have the necessary two years service to bring the claim.[2]The claimant has failed to make representations in writing, why this should not be done or to request a hearing. The complaint of constructive unfair dismissal is therefore struck out.[3]The Claimant’s remaining claims have been listed for hearing on 30 and 31 August 2023, subject to the Claimant complying with the terms of the Unless Order contained in the Case Management Order dated 28 March 2023.
