Employment Tribunals Rules of Procedure 2013 – Rule 21.[1]The Claimant was dismissed in breach of contract in respect of notice and the Respondent is ordered to pay damages to her in the net sum of £745.05.[2]The Claimant’s complaint of unapid holiday pay is dismissed upon withdrawal. REASONS

[1]No response had been received and the Claimant is entitled to a Judgment.[2]The Tribunal asked for a detailed calculation of loss to be provided to enable a Judgment to be entered without a hearing. A Schedule was provided but, when the Judge considered the papers under rule 21, he only saw the covering email of 23 June 2020 which dealt with the notice pay and holiday pay claims.[3]Upon reconsideration, it is clear that the Schedule sent with the email set out the details of the Claimant’s other complainst and the Judgment is varied accordingly.
