The claim in respect of unfair dismissal succeeds. The claimant was unfairly dismissed and the respondent is ordered to pay the claimant the sum of £1543.10 in respect of the unfair dismissal. The claim in respect of breach of contract succeeds. The respondent is ordered to pay damages for breach of contract in the agreed sum of £797.00 The claim in respect of unlawful disability discrimination succeeds. The respondent is ordered to pay the claimant the sum of £12,000 in respect of injury to feelings arising from the unlawful discrimination, with interest at 8% from the date of the acts of discrimination. The interest is calculated at 8% over 81 weeks at £18.46 per week, £1495.38. The Total due under the Judgment including interest is £15835.48. Reasons for the Corrections The breach of contract figure was mistyped at £779.90 which is actually the loss of earnings, as shown in the Schedule to the Judgment. The agreed figure in Case Number 1401974/2016 respect of breach of contract was £797.00. The total sums ordered, without interest, were £14,340.10. The total sum due is mistyped in the Order, the figure of £1395.38 having been pasted inadvertently over the overall Total intended to be shown. The Total due under the Judgment including interest is £15835.48. The Employment Judge apologises to the parties for the errors in the Judgment. Schedule Recoupment does not apply. The agreed basic award for unfair dismissal is £763.10 and loss of earnings £779.90, being 11 weeks loss of earnings net of 11 weeks contributory Employment and Support Allowance at £73.10 per week.
