JUDGMENT
PURSUANT TO RULE 22 NB This judgment takes account of the representations made, after the hearing, by the parties by emails dated 16 June 2025 and 23 June 2025 The first respondent has failed to present a response to the claim. The second respondent has stated that it does not resist the claim. The Employment Judge has decided that a determination can properly be made of the claims, or part of them, in accordance with rule 22 of the Rules of Procedure.[1]The claimants’ claims that the respondent failed to comply with the requirements of section 188 of the Trade Union and Labour Relations (Consolidation) Act 1992 in respect of their dismissals are well founded.[2]The Tribunal orders the respondent, by way of protective award under section 189(3) of the 1992 Act, to pay to each of the claimants a payment equivalent to remuneration for the period of 90 days beginning on 3 June 2024.[3]The Employment Protection (Recoupment of Jobseeker’s Allowance and Income Support) Regulations 1996 apply to these awards. In each case the protected period is the period of 90 days beginning on 3 June 2024.[4]The remaining claims of Mr Andrew Fielder, Mr Philip Allcorn, Mrs Stephanie Farley, Ms Ann Farnfield, Mr Adrian Lewis, Mr Jim Platt, Mr Lee Farrance are dismissed upon withdrawal.
