JUDGMENT

[1]The Claimant’s claims of breach of contract and for a protective award are dismissed upon withdrawal.[2]The Claimant’s claim of unpaid holiday pay succeeds and he is awarded compensation in the agreed sum of £2,173.66.[3]The Claimant is further awarded costs in accordance with rule 76 (4) of the Employment Tribunal (Constitution and Rules of Procedure) Regulations 2013 in the sum of £390, representing the fees paid by him in accordance with the Employment Tribunals and Employment Appeal Tribunal Fees Order 2013.[4]The Claimant’s application for costs under rules 76 (1)(a) and/or (b) is dismissed.
