JUDGMENT

The claims that the respondent breached its duty of care under the Health and Safety at Work Act 1974 and/or that the respondent was negligent in its performance of that duty are struck out on the grounds that the Tribunal lacks jurisdiction to hear the claims.

REASONS

[1]By a letter dated 11th December 2025 the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the complaint that the respondent breached the duty of care under the Health and Safety at Work Act 1974 and/or was negligent should not be struck out because;  The Employment Tribunal does not have the jurisdiction to hear it.[2]The claimant has failed to make representations in writing, or has failed to make any sufficient representations, why this should not be done or to request a hearing. The complaint of failure to provide a duty of care under the Health and Safety at Work Act 1974 is therefore struck out.[3]The claimant’s remaining claim(s) will be discussed at the case management hearing on 24th April 2025.
