The claim is struck out.REASONS
[1]The Claimant’s claims were dismissed as out of time against all Respondents save the Secretary of State by the Tribunal’s Order of 6 May 2011.[2]In the light of the EAT Judgment of 22 January 2016 on the Secretary of State’s appeal, liability for any claims arising out of the transfer rests solely with RJ Heathman (Contractors) Ltd t/a County Contractors. Therefore, the Secretary of State has no liability.[3]By a letter dated 10 February 2017, the Tribunal gave the Claimant an opportunity write to the Tribunal giving reasons why his claim should not be dismissed and that if he did not do so his claim would be dismissed without further notice.[4]The Claimant has failed to make representations in writing why this should not be done. The claim is therefore struck out.[5]The hearing listed in this claim on 21 and 22 February 2017 will not take place.
