JUDGMENT

The claim is struck out as against the second to seventh respondents inclusive.

REASONS

[1]In the Case Management Orders dated 22 December 2022 the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the claims against second to the seventh respondents should not be struck out because the first respondent accepts liability for their actions and is not relying upon the statutory defence under section 109(4) EqA.[2]The claimant has failed to make representations in writing, or has failed to make any sufficient representations, why this should not be done or to request a hearing. The claims against the six named individuals are therefore struck out.[3]The claims will continue against first respondent only.
