JUDGMENT

Upon the liquidator confirming that they will not be defending this claim the Claimant’s claims are determined as follows[1]The claimant’s claim that he was unfairly dismissed is well founded and succeeds.[2]The claimant’s claim that he was dismissed for a reason arising from his disability contrary to section 15 of the Equality Act 2010 is well founded and succeeds.[3]The claimant’s claim that he was wrongfully dismissed is well founded and succeeds.[4]The claimant’s claim that he was owed holiday pay on termination of his employment is not well founded and is dismissed Remedy The respondent will pay the claimant the following remedy[5]In respect of unfair dismissal, a basic award of £11,340.00[6]In respect of wrongful dismissal notice pay of £5399.52 Further issues of remedy[7]The question of whether or not any remedy should be awarded in respect of either disability discrimination or in respect of unfair dismissal, either by way of injury to feeling award or loss of earnings could not be determined on the information before the tribunal today.
