The claim is struck out.
REASONS
[1]The respondent company is in compulsory liquidation. The permission of the court has not been obtained for these proceedings to be instituted or continued as required by the Insolvency Act 1986.[2]On 23 February 2019 the Tribunal gave the claimant an opportunity to give written reasons by return why the claim should not be struck out as it had not been actively pursued. The claimant has failed to give an acceptable reason.[3]The claim is therefore struck out. _______________________________ Employment Judge Roper Dated: 7 March 2019 Respondent: Cgon Limited[1]By a letter dated 22 August 2018 the Tribunal gave the respondent an opportunity to make representations or to request a hearing, as to why the response should not be struck out because the respondent had not complied with the Order of the Tribunal dated 3 July 2018. it has not been actively pursued.[2]The respondent has failed to make representations in writing, or has failed to make any sufficient representations, why this should not be done or to request a hearing. The response is therefore struck out.[3]The respondent will be entitled to notice of any hearings and decisions of the Tribunal but will only be entitled to participate in any hearing to the extent permitted by the Employment Judge.[4]The hearing listed for 19 and 20 September 2018 has been reduced to 1 hour. The remedy hearing will now be heard on 19 September 2018 at 10:00am for 1 hour.
