JUDGMENT

[1]The respondent’s application dated 5 April 2023 to strike out, as a preliminary issue, the identified sections of the claimant’s claims for protected public interest disclosure detriment pursuant to section 47B of the Employment Rights Act 1996 on the grounds that they are out of time is refused. Any such time issues will be determined at the final hearing.[2]The claimant’s application to further amend her particulars of claim dated 22 June 2023 as contained in her further particulars dated 9 March 2023 is withdrawn by the claimant/ refused ( paragraphs 4.1.2, 4.1.3, 5.1.4, 5.1.5, 18,19 and 21) save that the claimant is given leave to amend her particulars of claim dated 22 June 2023 to pursue the allegation at paragraph 20 of the particulars dated 9 March 2023 ( relating to the claimant’s subject access request).[3]The matter was listed for a further case management hearing as separately notified.
