JUDGMENT
[1]The claimant is awarded and the respondent is ordered, by consent, to pay to the claimant a Basic Award of £102.60 in respect of the claimant’s unfair dismissal by the respondent (which is calculated as follows - £45.60 gross pay per week x 3 year’s full employment = £136.80 less 25 % reduction pursuant to section 122 (2) of the Employment Rights Act 1996 (“the Act”).[2]The claimant is further awarded and the respondent is ordered to pay to the claimant a Compensatory Award of £657.10 in respect of the claimant’s unfair dismissal by the respondent (which is calculated as set out below :-(1) Loss of net earnings in the sum of £341.20 for the period between 6 August 2016 and 30 September 2016 (8 week’s x net weekly pay of £42.65).(2) Loss of statutory rights in the sum of £16 (1.5 week’s x weekly pay of £42.65 – 75% pursuant to section 123 (1) of the Act).(3) Expenses in the sum of £ 299.99 in respect of job seeking expenses (£179.90) and cost of pay roll course (£120).(4) £341.20 +£16 + £299.99 = £657.10.[3]The total award is therefore £759.70.[4]The Employment Protection (Recoupment of Benefits) Regulations 1996 do not apply in this case.
