JUDGMENT

[1]The Claimants’ claims presenting complaints of unauthorised deductions of wages and failure to provide paid annual leave under the Working Time Regulations 1998 (WTR) were not presented within the applicable time limit, but it was not reasonably practicable to do so. The claims were presented within a further reasonable period. The claims will therefore proceed.[2]The Tribunal does not have jurisdiction to hear the Respondent’s counterclaim under Article 4 of the ETs Extension of Jurisdiction (England and Wales) Order 1994 (“the Order”) as neither Claimant has brought proceedings under the Order against the Respondent, as required under Article 4(d). Accordingly, the Respondent’s counterclaim is dismissed. Approved by
