EMPLOYMENT TRIBUNALS
Case No 1401252/2022
S PettittClaimantLuna 3-6-5 Healthcare Services LtdRespondent
Employment Judge Mr. M. SalterNot represented for claimantDate 3 February 2023

JUDGMENT

The claimant’s application dated 28th February 2023 for reconsideration of the judgment sent to the parties on 21st February 2023 is refused.

REASONS

There is no reasonable prospect of the original decision being varied or revoked. Throughout the proceedings the claimant has failed to comply with various tribunal orders including two orders from the Legal Officer, and a Strike Out warning enquiring if the claim was being actively pursued. The hearing had been listed by for some four months, by way of a Notice of Hearing dated 20th October 2022 yet, The Notice of hearing required the Claimant to supply, by November, information as to what remedy she was seeking: this was not provided. After the hearing had commenced, and with the Claimant not in attendance, efforts were made to contact the claimant. When telephoned by tribunal staff to ascertain why she was not at the hearing the Claimant told the tribunal staff she was in a car and “did not know if she would be attending.” After receiving this update from the tribunal staff the tribunal waited for the claimant to attend the hearing, but she did not. The tribunal has no record of the emails the claimant says to have sent. There being no evidence from which to determine the claims the Employment Judge considered the claims had not been made out.
