Mr O Loader v Saltern's Academy Trust and Hampshire County Council: 1401239/2022

EMPLOYMENT TRIBUNALS
Case No 1401239/2022
Mr O LoaderClaimant1.Saltern's Academy Trust 2.Hampshire County CouncilRespondent
Employment Judge GrayDate 10 May 2022

JUDGMENT

The claim is struck out.

REASONS

[1]By an email dated the 8th of April 2022 the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the claim should not be struck out because:  Under section 108 of the Employment Rights Act 1996 claimants are not entitled to bring a complaint of unfair dismissal unless they were employed for two years or more except in certain specific circumstances which do not seem to apply in your case. It appears from your claim that you were employed for less than two years. If so, the Tribunal cannot consider your complaint. As you do not appear to be entitled to bring this claim an Employment Judge is proposing to strike it out.  The Employment Judge had also asked for you to supply more information, surrounding the complaint you made against the respondent.[2]The claimant has failed to make representations in writing, or has failed to make any sufficient representations, why this should not be done or to request a hearing. The claim is therefore struck out.
