JUDGMENT
[1]The Claim for unfair dismissal is well-founded and the Claimant is awarded a compensatory award of £4,957.50 in respect thereof (£4,457.50 lost earnings and £500 loss of statutory rights).[2]The Claimant is awarded one week’s contractual notice pay and the Claimant is awarded a net sum of £445.75 in respect thereof.[3]The Claimant’s claim for a protective award is not well founded and is dismissed.[4]The total sum payable by the Respondent to Mr Roy is £5,403.25. 1 of 2 Case Number: 1401235/2025 and 1401842/2025 Case No, 1401842/2025 – Mr L Ollis[5]The Claim for wrongful dismissal (statutory notice pay) is well-founded and the Claimant is awarded one week’s notice – £653.25 gross.[6]Upon the Respondent being in breach of its duty to provide a written statement of employment particulars the Claimant is awarded four weeks’ pay pursuant to section 38 of the Employment Act 2002. The sum awarded is a gross sum of £2,613.[7]The Claims for arrears of wages and holiday pay are dismissed upon appropriate payment being made by the relevant Secretary of State.[8]The Claims for redundancy pay and for unfair dismissal are dismissed upon the Claimant not having the requisite service with the Respondent.[9]The total sum payable to Mr Ollis by the Respondent is £3,266.25.
