JUDGMENT

[1]The claimant was not a disabled person for the purposes of section 6 of the Equality Act 2010 and the claimant’s complaint of disability discrimination is therefore dismissed.

[2]The claimant’s complaint of constructive unfair dismissal is also dismissed.

[3]The respondent is awarded, and the claimant is ordered to pay to the respondent within 28 days of the date of this Judgment, costs in the sum of £2,808.50 pursuant to Rule 76 (1) of Schedule 1 to the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013
