JUDGMENT
[1]The Respondent did not have lawful grounds to dismiss the Claimant without notice or pay in lieu of notice and accordingly the claim for breach of contract is well-founded. The Respondent is ordered to pay the Claimant the sum of £3333.33 gross in respect of his notice period.[2]On termination of his employment the Respondent did not make a payment to the Claimant in respect of his entitlement to accrued outstanding annual leave under the Working Time Regulations 1998. Accordingly, the claim for holiday pay is well-founded and the Respondent is ordered to pay to the Claimant the sum of £923.10 gross.[3]The total award is £4256.43.
