JUDGMENT
The Claimants’ claims against the First and Second Respondents for unauthorised deduction from wages and failure to pay notice pay are dismissed upon withdrawal.REASONS
[1]These cases were listed for a full hearing. The First Respondent, Real Housing Foundation Limited, had not had a response accepted to either claim.[2]The First Respondent made an application at the start of the hearing for an extension of time to submit its ET3. After hearing submissions from both parties, I granted this application. Full oral reasons were given for this decision.[3]During the First Respondent’s application, it became apparent that the Claimants may have brought their claims against the incorrect respondent. After briefly viewing some documentation I granted the Claimants’ application to add Mrs Amanda Aimies as a Second Respondent to both claims.[4]During the following case management discussion about relisting the hearing, the Claimants indicated that they no longer wanted to pursue their cases. After a brief adjournment, the Claimants confirmed that they wished to withdraw their claims Case numbers: 1400926/17 & 1400927/17 against both Respondents. The Claimants confirmed that they agreed to the claims being dismissed upon withdrawal.
