JUDGMENT
Upon the tribunal being informed that Mr O’Neill and Mr Stanton do not challenge what is set out in the administrator’s letter dated 15 August 2024 And upon the tribunal being informed that Anna Barbara Wysocka has got married and her surname has changed to Macewicz And upon the tribunal being satisfied that the administrator has given permission for the claim against the First Respondent to continue And upon the tribunal being satisfied that there was no appropriate representative for the purposes of s.188(1B) TULCRA 1992 And upon the tribunal hearing oral evidence from Mr Cookson and Mr Jepp and considering the witness statements filed by all other claimants aside from the following: Mr Elliot Stanton, Mr Liam O’Neill, Mr Jesus Macchia Gallardo and Mr Artur Madej, none of whom filed a witness statement And upon the Tribunal being satisfied that more than 20 employees worked at the Voyager Park South site, the Hazleton Interchange site, and the Northarbour Road site and that it was proposed that 20 or more employees would be made redundant at each of those sites on 26 January 2024 And upon the tribunal finding that fewer than 20 employees worked at the Dakota Business Park site, such that s.188(1) TULCRA 1992 did not apply to that site ORDER[1]Anna Barbara Wysocka’s name is amended to Anna Barbara Macewicz[2]Lisa Nicholls’ name is amended to Lisa Hart[3]The following claims fail and are dismissed:a. Mr Artur Madej (1400816/2024)[4]Save for those claims specified at paragraph 3 above, the claimants’ claims that the First Respondent failed to consult pursuant to s.188 Trade Union and Labour Relations (Consolidation) Act 1992 is well founded and succeeds. A protective award is made at paragraph 5 below.[5]The First Respondent is ordered to pay the Claimants remuneration for the protected period pursuant to ss.189-191 Trade Union and Labour Relations (Consolidation) Act 1992. The protected period commenced on 26 January 2024 and ran for 90 days, concluding on 25 April 2024.
