JUDGMENT
[1]The Respondent concedes that it has unlawfully deducted the sum of £1,622.40 from the Claimant’s wages for the claim in question under case number 1400786/2020 and in breach of s.13 Employment Rights Act 1996.[2]The Tribunal makes a declaration to that effect and orders the Respondent to pay to the Claimant the sum of £1,622.40 pursuant to s.24 Employment Rights Act 1996 and as claimed by the Claimant at paragraph 54.2 of the Case Management Order of 25 October 2023.[3]The Claimant’s claim for an unlawful deduction of wages in respect overtime/TPM allowance remains listed for Hearing on 22 and 23 February 2024.
