JUDGMENT
[1]The Respondent made unauthorised deductions from the Claimant’s wages from 14 October 2022 until 28 October 2023. Accordingly, the complaint of unauthorised deductions is well-founded and the Respondent is ordered to pay the Claimant the sum of £690.95 gross.[2]On termination of her employment the Respondent did not make a payment to the Claimant in respect of accrued outstanding annual leave. Accordingly, the claim for holiday pay is well-founded and the Respondent is ordered to pay to the Claimant the sum of £264.38 gross.[3]The Respondent did not pay the Claimant for the days she worked during her notice period. Accordingly, the claim for breach of contract is upheld. There is no separate award of damages as the sum claimed is already covered by the award made in the unauthorised deductions complaint.[4]The Respondent did not issue the Claimant with a written statement of particulars of employment during her employment. Accordingly, the Tribunal makes an award under s.38 of the Employment Act 2002 and the Respondent is ordered to pay the Claimant an award amounting to 2 weeks’ pay, this being the sum of £694.54.[5]The total award is £1649.87. 10.1 Judgment – no hearing - rule 60 February 2018 Case No: 1400643/2023
