JUDGMENT
[1]The Respondent made an unlawful deduction from the Claimant's wages by failing to pay the Claimant in lieu of accrued but untaken annual leave on termination of employment. The Respondent is ordered to pay to the Claimant the gross sum of £1,749.96 (6.5 days x £269.23) in respect of the amount unlawfully deducted.[2]The Respondent was in breach of contract by failing to pay to the Claimant in lieu of six months’ notice. The Respondent is ordered to pay to the Claimant damages in the gross sum of £25,000 for that breach (being the sum of £35,000, which is six months’ gross pay, subject to the statutory cap of £25,000).
