JUDGMENT
The judgement of the tribunal is that the following claims are well founded and succeed: –[1]The claimant’s claims of an unlawful deduction from wages contrary to section 13 of the Employment Rights Act in respect of pay, holiday pay and commission; and pursuant to section 24 the respondent is ordered to pay to the claimant: –1.1 £1575.13 for unpaid wages for the month of October 2018, and 1-2 November 2018;1.2 £332.77 as accrued holiday pay;1.3 £675 for commission due (after deduction of 10% for clawback).[2]The claimant’s claims of breach of contract under the Employment Tribunal Extension of Jurisdiction (England and Wales) Order; and the respondent is ordered to pay to the claimant the balance of notice pay due amounting to £1109.23, and £723.34 as travelling expenses due.
