JUDGMENT
[1]The Claimant’s complaint of unfair dismissal was not presented within time for the purpose of section 111 of the Employment Rights Act 1996, and the claim is accordingly dismissed.[2]In the alternative, the Claimant’s complaint of unfair dismissal is struck out on the basis that the Tribunal considers it has no reasonable prospect of success.[3]The Claimant’s complaints of disability discrimination and of breach of the duty to make reasonable adjustments contrary to the Equality Act 2010 were brought within time for the purpose of section 123 of the Equality Act 2010.[4]The Respondent’s application to strike out the Claimant’s complaints of disability discrimination and of breach of the duty to make reasonable adjustments is refused.[5]The Respondent’s application that the Claimant pay a deposit in relation to her complaints of disability discrimination and of breach of the duty to make reasonable adjustments is refused.
