Mr B Wszelaki v Caribou: 1400087/2022

EMPLOYMENT TRIBUNALS
Case No 1400087/2022
Mr B WszelakiClaimantCaribouRespondent
Employment Judge Midgley DateDate 5 September 2022

JUDGMENT

The claim is struck out.

REASONS

[1]By an email dated 08 August 2022 the Tribunal gave the claimant an opportunity to make representations, as to why the claims (for redundancy pay, notice pay, and unauthorised deductions of wages) should not be struck out because the claimant is self-employed, and is not an employee or worker of the Respondent and so entitled to make the claims under ss.13 and 135 ERA 1996, and Article 5 of the ET(EJEW)O 1994, which can only be made by a worker or employee.[2]The claimant confirmed that he is self employed.[3]The Tribunal therefore lacks jurisdiction to hear the claims and they are struck out
