JUDGMENT
[1]The Claim of Wrongful Dismissal (non-payment of full notice pay) is wellfounded and the Respondent shall pay the Claimant £4,509.67 in respect thereof.[2]Pursuant to Section 38 of the Employment Act 2002 and upon the Respondent having been, when these proceedings were commenced, in breach of the duty under section 1(1) or 4(1) of the Employment Rights Act 1996 and the above award having been made, the Respondent shall pay the Claimant two weeks’ pay £819.94.[3]Upon the Respondent having paid a redundancy payment in excess of the Claimant’s entitlement by £614.96, that sum falls to be deducted from the sums detailed above.[4]For the avoidance of any doubt the total sum payable under this Judgment is £4,714.65. Case Number: 1400011/2024[5]The Claim for unpaid holiday pay is not well-founded and is dismissed.
