JUDGMENT

Following reconsideration, the Judgment of the Tribunal dated 28 June 2018 is revoked.

REASONS

[1]On 28 June 2018 I issued a Judgment striking out the claim on the basis that this claim had not been actively pursued.[2]Subsequently, on 22 October 2018 the Tribunal was contacted by the claimant’s agent who advised that unfortunately the claimant had died and this was the reason correspondence had not been replied to. The claimant’s son wished to take over the claim as executor.[3]I considered that in the circumstances it was appropriate to revoke my earlier Judgment and reinstate the claim.
