The claim is struck out.REASONS
[1]The Claim was listed for Final Hearing by CVP on 11 and 12 April 2022 as set out in the Notice of Hearing dated 13 May 2021.[2]The Claimant did not attend the Final Hearing by CVP on 11 April 2022. He did not contact the Tribunal or the Respondent. The Tribunal contacted the Claimant by email. He did not respond.[3]The Claimant did not address the points set out in the Tribunal’s letter dated 29 March 2022 when he was asked if he had exchanged witness evidence with the Respondent and if not, why not, and whether the Bundle was agreed.[4]The Claimant did not exchange witness statements with the Respondent prior to the Final Hearing.[5]The Claimant’s claim was therefore struck out on the following grounds:• Non-compliance with the Tribunal’s Orders dated 13 May 2021• It has not been actively pursued.[6]The hearing fixed for 11 and 12 April 2022 will not take place.
