JUDGMENT
[1]The claimant was disabled for the purposes of s6 of the Equality Act 2010 from April 2019 by reason of depression and anxiety.[2]The claimant’s claim that her dismissal was unfair contrary to s94 of the Employment Rights Act 1996 (ERA) because it was not fair in accordance with the principles set out in s98 is dismissed on withdrawal. Her claim that her dismissal was automatically unfair contrary to s103A of the ERA is not affected.[3]It is in the interests of justice to allow the claimant amend her claim to include the claims referred to in paragraphs 11.6, 11.7, 11.12, 11.13, 13.1 (e),13.2 (e), 14.1(b), (c) and (d) of the claimant’s amended further and better particulars dated 15 February 2021 and leave is granted for those purposes.
