JUDGMENT

[1]The Claimant’s claim for holiday pay succeeds. The Respondent made an unlawful deduction from the Claimant’s wages by failing to pay the Claimant sums owed in lieu of accrued but untaken holiday, and was in breach of the Working Time Regulations 1998 by not paying the Claimant the leave to which she was entitled on termination.[2]I order the Respondent to pay the Claimant the sum of £291.11 gross in respect of holiday pay. The Respondent is entitled to deduct such tax and national insurance contributions as may be appropriate before payment is made to the Claimant. In the event that this has not been paid within 14 days after the date on which this decision has been sent to the parties, interest shall accrue from the day after the date on which the decision was sent, at a rate of 8%.[3]The Claimant’s claim for unpaid commission does not succeed.[4]The Claimant’s claim for interest from the date of termination to the hearing date does not succeed.
