Mrs C Plant (Nee Lardner) v Integral UK Ltd: 1309189/2022

EMPLOYMENT TRIBUNALS
Case No 1309189/2022
Mrs C Plant (Nee Lardner)ClaimantIntegral UK LtdRespondent
Employment Judge FloodDate 8 January 2024

JUDGMENT

The claim is struck out.

REASONS

[1]By a letter dated 21 June 2023 the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the claim should not be struck out because it has no reasonable prospect of success. This is because the claimant accepts that she TUPE-transferred to another company, Linaker on 01 July 2022. When she TUPE-transferred, any claims she had against the respondent transferred to Linaker. The respondent is not in law responsible for the issues she has evidently has with Lianker connected with and following of the transfer.[2]The claimant has failed to make representations in writing, or has failed to make any sufficient representations, why this should not be done or to request a hearing. The claim is therefore struck out.
