JUDGMENT
The respondent having been correctly served, the administrators having given consent for the claims to proceed, no Response having been received and, on the basis of written representations from the claimants’ representative, the judgment of the tribunal is that:[1]There being no recognised trade union or employee representatives, the individual claimants set out in the attached Schedule (‘the claimants’) have standing to bring this claim.[2]The claimants’ complaint that the respondent failed to comply with a requirement of Section 188 of the Trade Union and Labour Relations (Consolidation) Act 1992 as to collective consultation are well-founded and succeed.[3]The tribunal makes a protective award in respect of each of the claimants and orders the respondent to pay each of the claimants remuneration for the protected period of 90 days beginning on 11 July 2022 (the date on which the first of the dismissals to which the complaints relate took effect).[4]The Employment Protection (Recoupment of Benefits) Regulations 1996 apply to this award.
