JUDGMENT

[1]The complaint of unauthorised deductions from pay contrary to Part II Employment Rights Act 1996 is well-founded. The respondent made an unauthorised deduction from the claimant's pay in respect of the not paying her for 1 weeks' notice she worked between 24 May - 27 May 2022. The respondent is ordered to pay to the claimant the gross sum of £247 deducted from pay. This figure has been calculated using gross pay to reflect the likelihood that the claimant will be taxed upon it as Post Employment Notice Pay.[2]The claimant's claim for breach of contract is relation to the week she worked in hand for the respondent between 5 July 2021 -9 July 2021 is well founded. The respondent is ordered to pay the claimant £231.66 as damages. This figure has been calculated using gross pay to reflect the likelihood that the claimant will be taxed upon it as Post Employment Notice Pay.
