JUDGMENT
[1]The Claimant's claim for breach of contract is not well founded and is dismissed.[2]The Claimant’s claim for unauthorised deduction from wages succeeds and is well-founded. The Respondent shall pay the Claimant the sum of £560 net in respect of 8 occasions when bank transfers were made between 24 September 2018 and 4 March 2019 which failed to include sums in respect of the Claimant’s entitlement to sick pay or for attending College.[3]An award of £800 net, being the amount equal to four weeks’ pay, shall be paid by the Respondent to the Claimant under s38 of the Employment Act 2002 in respect of the Respondent’s failure to provide a written statement of employment particulars.[4]The Claimant’s claim under s11 Employment Rights Act 1996 regarding the Respondent’s failure to provide an itemised pay statement succeeds but no award is made. 10.2 Judgment - rule 61 February 2018 CASE NUMBER 1307555/2019
